Mango sentenced for copying Isabel Marant

For several years now, Isabel Marant has gone on the attack on the counterfeiting front. The brand's shoe models are most often the focus of all the attention, and the bone of contention too. The Parisian designer has recently won a new ruling on the issue, against the Catalan retail chain Mango.

The claim was filed in 2013, and the proceedings ended with a ruling by the Paris District Court, which sentenced Mango for counterfeiting with regards to Isabel Marant's 'Scarlet' booties model. The differences detected between the two products were deemed to be insufficient, and Isabel Marant's and her company's intellectual property rights were indeed breached.

However, the calculation of the revenue generated by Mango with this product sparked a debate. Relating only to France, since the issue falls under French jurisdiction, the revenue was estimated at €350,000 by Isabel Marant's attorneys, based on a price of about €100 net of tax. The other party instead put forward elements which limited the revenue to about €27,000. The gap was huge.

The court eventually relied on the second estimate to calculate the amount of the fines it imposed: €20,000 in favour of the Isabel Marant company, as well as €10,000 in damages for the designer. The compensation was supported by official publications, but it appears to be limited as it applies only to France, given that Mango has presumably sold the model recognised as counterfeit on a worldwide basis.
